I’m also including a screen of this form, which You can find on many “storage” sites. The PDF they they want to upload is at the bottom of this form.
That’s definitely the DMCA in .pdf format. The main form in that screenshot only contains general information to get in touch with you but it’s missing the important structures of a DMCA, such as Sender Information, Recipient Information, Infringed Content, Infringing Activity, etc. You need to manually create/fill in a DMCA, save it as .pdf and attach it to that form. In that DMCA you also need to include your digital signature and the statement ‘I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law…...’

Once you have done your first template just save as an editable format and you will only need to change little information for future notices.

Pirates are out there. I just wanted to share a company – DMCA Pro – that I use to take care of takedowns for me. As soon as I added them for 1 item I saw my sales increase (sad but true). As authors it is something we definitely need to be aware of and sometimes the amount of time involved with sending out DMCAs for a single product can be a hassle. <this message is from an author>
Great question. I don’t think ratings are somehow associated to piracy. When a customer takes the decision to purchase an item because they didn’t find it for free or just because they feel they want to do things the right way this time, they only expect to get something good in return, they need to feel that item worth the money. For example, they expect to get support from the author, they expect to get the item working easily, etc. When they don’t get that then they feel frustrated and they go ahead and submit a bad rating, with a comment like: ‘I wish I had found this for free’
That’s one of the many reasons we encourage authors to provide support, because one of the benefits of purchasing the item instead of getting it for free on illegal marketplaces is that you can get support from the author.
I believe that sometimes they also submit ratings without even asking for support, maybe they didn’t know how to install the item and there are lots of possibilities and scenarios, but in these cases if you feel there is an unfair rating, Envato Support will be happy to review it.
I need help. On some sites, when I try to fill their Report Abuse/DMCA they want this: “Upload pdf file that has approvement of Your rights for content”.
Well can someone tell me, what exactly they want from me? When I create items for GR, what is my approvement of right fot that item?

We would need to check the website in question and see the abuse contact form in order to see what they want. There are some websites where you can fill in a form with your personal details and explain the illegal activity but you need to attach a DMCA in .pdf format anyway, this could be what they are asking for.
There are two different ways to submit a DMCA depending on the website. One way is the ‘free-form’ and it’s basically a document you have to fill in manually and save it as .pdf format; that .pdf must be sent via email address or fax to the company in question. The other way is ‘web form’ or ‘abuse contact form’; it’s an online contact form that you need to fill in with the same details you use in the regular ‘free-form’ notice. What’s the difference? No difference, the web form is just faster because you don’t need to generate a DMCA in .pdf format, attach it and send it.

Sure, talk to devs/search on google, I don’t think it would be hard at all. On the other hand, I don’t really see Envato shutting down accounts… this is of course, my personal opinion.
Pirates will continue finding their way, but if a few accounts get closed and you advertise that, they will have doubts, and most of them probably won’t share the zip file. Is about seed of doubt, of fear. And you can always change the signature, or even better, have multiple signatures, to the zip files, to other files like images, and other methods too. Every downloaded zip could have multiple signatures, create one or two very easy to crack. Then have a stronger one behind. Trick them. Open a new thread so the community can come up with ideas if you don’t want to hire the pros.
Sending DMCA notifications take a lot of time/work/effort. The pirates have improved their ways, multi-uploads at once, closed forums, registrations, redirects services to remove referrers, file status checkers, torrents. And all we do is send emails, one by one. And create a thread saying “we fight piracy”? Really? If they are reading this they must be laughing pretty hard.
When you search on google for a popular item, and you find the zip, then it means that sending DMCA notifications don’t work. After all, if after a file is taken down, it comes again the next day, how many times are you willing to do that?
As said before, what about partner up with people who are already working on this?They are thousands uploading and sharing illegally. Is time to come up with a new idea.
I definitely agree that we should come up with new ideas, but again, we are talking about a problem that is hard to solve, there is no company at the moment that has been able to solve this effectively.
It’s also important to get better at the things we already know; for example, DMCAs look easy but actually every company is a different world, they comply with general copyright rules but there are companies that do not accept more than 10 infringing links in a single DMCA submission or maybe they think that DMCAs should be sent from an email address from Envato or they just want more specific details about the illegal activity happening with your item. These are common issues that make the process slower but we are always trying to improve it to send more effective DMCAs and get content removed faster.
I think every single resource is valid these days and of course security is important too.
one colleague I know who has a moderately big business said he even hires a fulltime paralegal to do nothing but send DMCAs all day. That’s likely money well spent, if Envato can, as paralegals (people who are studying to be lawyers, but aren’t fully ones yet) may be a big help, either part-time temporary or fulltime, to hire to send DMCAs out.
It really does help, and if envato becomes known as having a new tough anti-piracy department w/staff that goes after this, even if just a single paralegal searching for and sending DMCAs, that could really help protect sales, which is good for everyone. I hate pirates, it wastes a lot of time going after them, but it is unfortunately a necessary admin task.
otherwise look what happened to the adult/xxx online site industry; they’re a good leading indicator of internet sales in general, with all the free ‘tube sites they’ve been decimated, with their sales down a lot (and likely forever from now on) because they didn’t take enough time for anti-piracy actions. adult is a very good ‘sign of times to come’ and you don’t want all your assets on free blackhat forums (and being resold by unauthorized “modify/create a video or wordpress theme for five bucks” type sites).
It really requires your attention, I’d step up enforcement a lot in 2014.
-kalso as a buyer it bugs me a bit that competitors can get for free/$5 stuff I paid a lot more for, as a top buyer here on envato. main thing is hire a paralegal to send DMCAs all day, money well spent for envato imho. or at least make it a temp job to see how it goes at first, someone who can be trained on how to use google alerts to ID infringing content, then how to draft and send DMCAs. Speaking of team efforts, you could also have a “fight piracy/report infringing links week” here, to have authors report links that could be gone after, on unauthorized modifier/$5 type sites as well as blackhat forums/blogs. That’ll give your paralegal months of work to go after, which is worthwhile. And please restore my sheriff’s badge, lol – lots of solid advice I’ve given.

I think Envato should partner up with one of these online services to watch out for our items. And then offer us the service for, lets say, 5 or 10 USD per month per item. There are a lot of items, a lot of money can be made out of this.
I also think that the zip files should be somehow signed. So we can know who is the buyer distributing the file, and can take his/her account down. How hard could it be to put some metadata in a zip file?I agree with @Creattive, Envato does very little or nothing about fighting piracy. Some time ago I contacted Support, there’s this closed forum with thousands of Envato items. I paid the fee to get in (10 miserable USD), and I wanted to give the credentials to Support, they wouldn’t want them! The last message I got from you Ibrahim took 2 months. Ticket: 195730 (year 2012) Of course the closed forum is still there, up and running.
A while back I opened support ticket to send links to 3 websites with over 2 thousand items from ThemeForest and CodeCanyon, each with multiple download links, and I got some generic reply that there is not much they can do, and that I should send DMCA on my own. I stopped wasting time on searching such websites, I can’t do much alone (or I would spend whole day doing only that), and it is obvious Envato doesn’t care too much about it. One website was owned by the user with account on Envato, and that was not enough even to remove his account from Envato network: 6 months after my report, that user still had active account, and still running his piracy website.
Would be much easier for Envato to gather links from those websites, create DMCA lists on behave of all authors affected and send them, and then take action against websites owners. It would be more efficient, than to have each author spending awful lot of time tracking and sending DMCA for own items only.
So far, I can see that Envato is talking big on fighting piracy, and doing (almost) nothing, not even wanting help from authors when they want to report websites. I understand they can’t shut down websites in some parts of the world with DMCA, but there are other methods that big company like Envato is better suited to use than each author on its own.Milan
Thanks for your comments. We already create and send DMCAs on behalf of our authors, we do that every day and we’ll continue to do so. We are not trying to get rid of that specific activity at all, we are just trying to focus now on websites distributing large amount of items while you send your own DMCAs for individual links. We know that some of you don’t know a lot about DMCAs and the required procedures to report illegal content, that’s why we have created these resources and guides, to make things easier for you when sending your own abuse reports.
We love help from authors, we are always happy to receive your reports, but we can’t disable accounts without investigating and having enough proof, we need to be 100% and that can take some time.
