Hi all,

I was under the impression you couldn’t just grab product photos from some big company like Apple, Microsoft, etc. for use in themes. You need a liscence or ownership.

When is this okay? Surely Apple wouldn’t be too happy about their logo/products all over themes and I shouldn’t imagine you can just get permission to use them.

Nothing against the author of this theme, it’s just an example.

Not if the theme source was protected with javascript.

How about opening a live-preview in a new window with no toolbars and right-click disabled? That wouldn’t be difficult at all.

Nobody wants their theme code ripped for free. Could you not just stick the live-preview frame at the top of the page without giving people the option of removing it with one click and then stealing everything? The frame hardly gets in the way of the preview, does it? And the raw theme code could be protected pretty easily with some Javascript. I can bet a lot more users would feel confident about submitting work and more money is made at both ends. Everybody wins.

To be honest, you’re the only person who can figure that one out. There are no fixed prices for creative work – it really depends on your situation and nobody elses. You need to consider your ideal weekly/monthly income and when you’ve worked that out, set yourself an ideal hourly/daily wage.

I recently had to figure out my numbers, too. I started by finding out how much money goes out every month (internet, phone, rent, etc.) and then gave myself an ideal number for monthly income to weigh up my profit. I then divided that number a few times to work out how much I need to charge per hour/per day.

That site used to be pretty funny, but now it’s just 90% bullshit. The stories on there are so made up, it’s rediculous. It’s just one big stale joke.

How did he agree to your terms? If you can clearly show an email or any form of writing in which the client agreed to particular terms and then failed to follow up, you’ve got a case. If you met with him and he only verbally said ‘yes’, I can’t think of a whole lot you can do, mate.

@cmt – If your template is accessible across major OS and browsers – so people can actually use it – then there isn’t a problem. IvorPadilla just directed you to a script you can use to force major support for HTML5 . There’s your answer.

The fact that you didn’t attain formal agreement – whether a signature or just confirmation via email – is entirely your responsibility. How exactly did you go about presenting these “terms of service”?

Your situation sucks, I agree, but the client is only exploiting your inability to protect your work.

If you did the work legally – that is, paid tax and such like – and provided clear expectations which the client agreed to then make a case out of it. Otherwise, yes the client is being a douchebag, but you let him be.
