We found out there’s a guy that hacks our plugins from Codecanyon, and not only ours, there are tons of plugins / themes from other authors (Themeforest as well)
Not only that he’s hacking our products, but he charges people money to download the products.
We are pretty sure that he buys the products legally, trough Envato, hacks them and sells them.

We made a complaint to [name], but no reply so far.
What can we do about this issue? Can Envato help us with this issue? Can this user be tracked? Can we do anything?
Clearly is illegal what he’s doing, DMCA does not apply here, and we cannot find any way of stopping this.

I recommend using a lighter, less rounded font (you can take a look at the latest PSD templates, and see what other authors are using).
Also, your spacing is not right, try using some grids and stick to the same box spacing (on some places you don’t have enough space, on some places you have too much space)
Also I don’t recommend using italic fonts to much, especially on headings.

Okay so you posted needing recommendations and advice about what to do with your design so it gets approved. So here are my two cents:
1) In the responsive mobile view port remove the shadow around the nav http://glui.me/?i=vnshbq0lbcxaqfz/2013-09-28_at_8.25_AM.png/ and instead replace with a light border. Those outer glow shadow effects are so old.
2) Consider creating some simple but attractive logos to replace these http://glui.me/?i=cf8i6x6t3gqf0ys/2013-09-28_at_8.32_AM.png/
3) I know this is a nutritional website and you want to add food items in the background where ever possible but please don’t do that because…well it just doesn’t look so nice. Consider replacing the background images you have here http://glui.me/?i=eo5vvubdgkfygp8/2013-09-28_at_8.33_AM.png/ and here http://glui.me/?i=al69bs03pahmdqt/2013-09-28_at_8.38_AM.png/ to just a flat color. Btw, if you right click and view the location of those images you will see a crazy huge url and that to me and other I am sure is a no-no. The fact that you’re taking that small image and stretching it to fit the entire width of its container I think is what’s causing part of Themeforest comment about bad practices.
4) Strokes like this are old http://glui.me/?i=simhu804qmeh3ym/2013-09-28_at_8.46_AM.png/ consider doing something else to make that banner image look nicer and more modern.
My final thoughts – Remember, that the quality that Themeforest expects for certain categories evolves from time to time which is why this is not getting approved for the Wordpress category. Keep in mind that what’s in these days is flat and metro UI’s. That’s not to say you cannot try your luck with a different design approach.If you really want to keep this design looking the way it is consider creating a few different design styles one of them being a la’ flat design style allowing users to toggle between different design styles. And for your theme preview default to a flat design style.
