Hey Jaap, first of all respect for your post. You may be under the impression that this thread is about you but it´s not. It´s about a system that allows and maybe even misleads authors to act in a way which leads to damage the marketplace and its participants. Believe me or not, I don´t blame you for being exclusive here and selling somewhere else. But I blame AJ to act so carelessly in regards of featuring “exclusive” content as this is simply not appropriate for all of us. I can´t help but think that AJ just does not care about what is going on on other sites, which they are obliged to do since they offer exclusivity. And it´s not that hard to see what´s obviously going wrong. Again Jaap, big respect for you and your disclosure. It was just the tip of an iceberg.
So why do you not just report Exclusive Authors uploading their original content to other Marketplaces ?
Did you actually read what this is all about? I don´t just report as I am tired of doing this. Period! It´s not my job. I care about my business. And by the way, I happened to find you on another site putting up your portfolio at the same time you decided to have a non-exclusive account here an AJ and naturally on other sites as well. There were a few “new” tracks but also one track you´ve sold exclusively her on AJ. I don´t remember its name and to be honest I just don´t care and maybe you removed it in the meantime and yes, it was just one track, but you know, before having the guts to participate in this very thread and claiming yourself as a loyal author here on AJ I would advise you to care about your own business.
I understand to AudioQuattro. You must be losing a lot of money by following the rules.
I hear that! It’s not 17% for Ralf these days (or me for that matter), but 37% that we’re giving up for the privilege of being able to post elsewhere and playing by the rules.
That´s the point. Joel hit the nail, we´re giving money up for the privilege of being able to sell our stuff elsewhere. We don´t lose money here, we´re just playing by the rules which we get to know before signing in and agree to. If anyone is losing money here it´s Envato.
It costs us Non-Exclusive artists a minimum of 12% to play the game. I’ll be damned if I stand by and watch someone else play the same game and break the rules that I’m paying to follow! If I see/hear it I won’t hesitate to open a ticket here immediately as well as opening one at the other site. It’s simply not fair to the honest players and I agree with Tim that a permanent ban should be the penalty. Thank you AQ for stepping up. I admit, I don’t spend enough time listening to other authors music (as Matt will tell you ) but I have heard a few bigger selling artists here using an almost identical “re-work” of their popular AJ-exclusive tracks. Can I assume this is a violation also?
This is also something I wondered about recently, but again, nobody seems to care, nobody seems to wonder. It just happens. I would love to go exclusive here on AJ, getting finally a fair cut for my music. I then would love to take all of my tracks, change a note here and there, leave something out, add something else and then sell those on any other site.
Understandable that it’s a big task to police, however, when it is discovered that a user is uploading exclusive music to other royalty free sites – ban them for life.. This isn’t something that really needs second chances is it? A harsh penalty would greatly discourage it I believe. The main people do it is because the ramifications are so small.
That´s what I would have expected as well. I remember one case, one of the very few I reported to support, when I was pointing AJ to an exclusive author who sold his stuff somewhere else. Same name, same titles, no difference at all. And he was doing that for a very long time as I was able to find out. Support answered that they are aware of this guy and his cheating but that there´s no further action necessary as he somehow decided to opt out from exclusivity anyway. At least I would have expected they would ban or disable his account for the time it takes until he is non-exclusive. But nothing happened, the guy continued to sell at an exclusive rate for continuing 4 weeks as a punishment for breaking the rules.
What concerns me most however is that we non-exclusives (sometimes I get the feeling we’re a sort of rogue sub-community which shouldn’t really be participating in Envato forum discussions), have to be responsible for the policing and reporting of this. It puts us in a very tight and difficult situation indeed, which of course is not our job.
AJ isn’t the only marketplace where this is happening however. I’ve seen it on others too, and it’s beginning to look like a real problem. As you suggested, not only does it highlight an author’s integrity, but also completely demotivates fellow authors who are playing by the rules, especially when they’re clearly being put at a disadvantage by this.
Exactly! I´m observing this since a few years now and initially I felt somewhat petty and stupid to contact support and telling them that “exclusive” author xy is selling his music also on site yz so I stopped doing it and tried to ignore it somehow. As I said in the initial post, I´m really tired of it. I´m not the internet police. But after finding such cases again and again I somehow felt that this is getting out of control. And I think that it is the duty of Envato to ensure that their featured exclusive music is really exclusive. I know I´m repeating myself, it may be hard to do that, maybe sometimes even not possible to find all cases, but they DO owe this to the customers and last but not least to all non-exclusive authors as a sign of respect and fairness in light of getting just 33% of the money. As Matt mentioned, it´s not the job of us non-exclusives to report. And in the long run, this does NOT only affect non-exclusive authors but especially the exclusive ones. If I were an exclusive author, I would be worried about this situation as AudioJungle is facing a very arguable future with those cases happening again and again.
As a non-exclusive author I am quite often browsing other marketplaces to see what´s going on there and again and again I stumble upon composers who are exclusive authors here on AJ while selling their music somewhere else at the same time . Some of them are renaming tracks in a rough and careless way, some even don´t.
First of all I have to admit that this really p**s me off big time. I´m selling here on AJ as a non-exclusive author since more than 5 years now getting my generous 33% cut while many other guys are steadily climbing up the ladder to a decent 70% cut due to the fact that they are claiming to be exclusive, which in fact they are not. Not only are those guys cheating Envato and the customers buying here, but also all the other composers who are honest and fair and therefor getting way less money on AJ. Secondly I think that Envato has to do something about it. If they really focus on having exclusive music on their site I would assume they have to care and ensure that the music they offer exclusively cannot be found somewhere else. Now I know that this is a huge responsibility and sure a lot of work to maintain, but as a business they are owing honesty to their customers.
I know that customers do not only browse through AJ, but also keep an eye on other marketplaces and I can somehow imagine that featuring non-exclusive music as exclusive can make a very bad and highly unprofessional impression and bring damage to this marketplace on the long term. And this would have an impact on all of us, the non-exclusive authors, the exclusive authors and of course the so-called exclusive author. This fact, featuring non-exclusive material as exclusive combined with irritating low prices (which rightly has been discussed in countless other threads) and confusing licensing can´t and won´t be the future of this marketplace.
And I´m quite sure that someone from Envato will ask me to contact support whenever I find an “exclusive” AJ author on any other website, but I´m tired of pointing fingers and naming names.

There are other sites out there that have no review system at all, and believe me, they are filled to the brim with unusable, ‘musical’ junk, by so called ‘professional composers’.
