Hello While is certainly never fun to have a DMCA filed against your item, your correspondence should always go through the Support ticket as we are not able to address DMCA issues on the forums.
As for your idea of removing and then resubmitting the item, we would advise very much against doing that as it could result in your account being disabled. Please see our Knowledgebase for more information. In particular:
Please note that once you delete an item you cannot change your mind, and the marketplaces do not allow authors to re-upload previously deleted items.
When you click on the big green download button, one of the options will be to download only the installable WordPress files.
