you can’t use the logos at the bottom as they are copyright – and I believe one of the pictures in your slider is an actor – you should replace those for sure.
I would show drop down menus also.
apart from that pretty much what is outlined in the reply you received.

Thanks for the tips about the logos, I didn’t know, I’ll change that. Either than that I still can’t see what to change with what is said in the reply as I’ve been looking at it for too long, that’s why I need some external feedback.
Well, another disappointed thread here. I have submitted my theme 2 days ago and it is rejected:

1. Your file has some well done design concepts, however it does not meet the current and very stringent quality guidelines and we can not accept your file at this time. You will need to make some additional improvements in overall aesthetics.
2. There are a few inconsistent spacing issues throughout the design.
3. Overall typography needs additional refinements and improvements before it will be ready for sale.4. Even with the current design, a significant increase in the polish of the various aspects of the item may just swing the decision in your favor.

I believe responsive is not a issue itself but more the way it has been integrated. A good responsive approach shouldn’t be removing/hiding content that you could find on the desktop version for the sake of been mobile but should simply display the same content flawlessly for smaller screen and keeping the content easy to find.
I would happily stay on a mobile version on my phone rather that the desktop if it has been well thought.
I like it pretty much, very good attention to detail, well done! For the menu, I would have reduced the white gradient a little. Is it going to be a WP theme?
Looks like a pretty big slider.
Let’s say you want 1 pixel to jump every 200 000 with a max of 1 000 000 000, that means your slider has to be 5000 pixels width (5000×200 000), unless your slider move when you reach the end of your 800 pixels, it is not very user friendly. I would recommend to use a simple input tag, unfortunately.
It looks like the marketplace will be crowded (or already is) with a lot of themes that are no more being bought.
My idea would be to have rules over templates and say that a theme that hasn’t been bought more than 20 times or something over 3 months should be removed. That’s just a example.
If nothing is done to do a spring cleaning the marketplace will be over crowded… How do the buyers to search a theme anyway? Me, filter by sales or by ratings.
