Just a quick note to let you know we’ve made a slight amendment to the Tools License at clause 5.The old clause 5 looked like this:
5. You can’t re-distribute a Tool or App.The new clause 5 looks like this:
For example: You purchase a PSD brush; you can’t give the brush file to a friend.
5. You can’t re-distribute a Tool or App (this includes no public distribution, display or performance). You also can’t modify or make derivatives of a Tool or App.
For example: You purchase a PSD brush; you can’t give the brush file to a friend. The Tool or App is licensed to you ‘as is’ and is a complete item that cannot be modified.
Thank you everyone for the feedback on our new Marketplaces and Author Terms. I just wanted to let everyone know that as a result of the feedback we’ve received about section 27. Library review of the new Author Terms we have decided to make some slight amendments to that section.
As already outlined by Collis in this thread:
There are some rights (like this one) that are important to reserve for the occasion when you need them. Being able to pull an item off the marketplace quickly before notice goes out, or if it’s not possible to send notice for some reason, is an important capacity for us to have, so we keep it in the terms. That doesn’t mean we exercise it arbitrarily, or that we don’t subsequently send notice to the author in some form.
To better communicate this point the new section 27 will now read as follows:
27. Item removal: We have the right to remove an item for any reason, using our reasonable discretion. For example, we may review the libraries to keep our Marketplaces fresh and full of quality items that meet the latest technical standards and market trends. Also, issues about an item might be brought to our attention such as errors, representations, or even violations. Our goal is always to address these situations with you constructively. We also aim to give you notice before an item is removed, but this is not always feasible or possible, so we can’t guarantee this. We will not be responsible for any loss that you may suffer as a result of your item being removed.
The change will go live later this week. Thanks again.
After your updating, at me each time emerges the message on updating. It very much isn’t convenient. You couldn’t disconnect this message?
Hey SinDator, you’ll need to click the “Thanks, I got!” button before that message stops appearing. If you still see the message after you’ve clicked the button raise a support ticket here. Thanks.
27. Library review: We like to keep our Marketplaces fresh and full of quality items that meet the latest technical standards and market trends, and so we may review our libraries from time to time. We may remove an item from our Marketplaces at our discretion, for any reason and at any time without notice to you. We will not be held responsible for any loss that you may suffer as a result of your item being removed.Really scary and disturbing part…
Hey Anps, sounds a little heavy handed in isolation but we need to be able to do this to protect our community and make sure our Marketplaces contain items that are legitimate and deserve to be on there! Nothing new, just a little easier to understand now!
Hi, I am not sure about the ecommerce templates can we use product photos from the producer site? Because I see that many templates use photos from Nike website or something like that is that OK ?
You can only use a real world product if it follows Exception 1 – incidental use; Exception 2 – not identifiable to a particular manufacturer or Exception 5 – only in previews to show compatibility or implementation. See more details here.
Cheers and happy holidays!!! Peter
