i’ve had a similar question recently but for Audiofiles. While other non-exclusive Authors opinion was, that it’s not O.K., we never received a official statement from Envato. Envato’s point is quite clear, they don’t want you as exclusive author to sell “similar” items elsewhere and they won’t do you a “favour” and say that it’s ok if you alter the file.
But from a legal and fair point of view, i would say that if you for example have a common / generic object like a soda can and you change the label and backgrounds and keep only the can itself, it is not a problem. A soda can is a soda can and looks the same all over the world (most of them). I for example invest another 5-10 hours to re-work my items and i don’t see why i should not be able to sell this different product elsewhere.
If i sell a T-Shirt with a Car on it in store A, why should i not be able to sell the T-Shirt in store B with a Plane on it ?
Sure, Envato makes the rules and if they want to punish you for doing so, they simply can. So i’d say it’s up to you what you want to do i guess .
i live in the northern part of Switzerland, but i do know Lausanne as well. It’s a “student city” and you will find a lot of options for more or less cheap food and living in a student community (if you want to). Otherwise it’s as some others already explained a very expensive country.
Many people from abroad think, everyone in Switzerland is rich, that might be so if compared to the income somewhere else. But if you check the prices here, you will need a good job to feel rich in Switzerland For artists and people with not so good jobs, it can be quite a hard place to live (money wise only for sure).

i mainly do Photoshop Mockups for Graphicriver, as they sell more or less well. I asked the reviewer to review the complexity of my file and price it accordingly fair. My mockups are not a static picture with one smart object that sets the label over the 3D render. Every single object has a Alpha Channel / Mask and can be toggled on and off.
For this particular Mockup i spend like 2 full weeks from 3D Package modeling (scanned a real tray and modeled it) until the final Photoshop Mockup with the illustrated manual. I always record my working hours and it cam to 78 Hours for the 2 Templates and all included files.
So i asked for a price around $9 as i thought this would be fair for all the work i had. I only “ASKED” in the reviewer comments field of the upload and got this answer :
“Thanks for your request to review pricing on your item(s). Your suggestion is a recommended price only and there is no obligation on Envato to comply with the recommendation. We will make the final decision on your item’s price.”
Sure i know, i can’t dictate the price for my items, this is why i friendly asked to review the complexity of the file and did not expect such an answer.
However, if these items are priced that low and i am sure i can find them within a week on warez site, i think it’s just not worth the work.
What do you guys suggest, or what are your opinions on the prices for Mockups ?

We currently have over 5’000 tracks online and are top ranked in Google search. We are also the top Group regarding contributions and members for RF Audio on Soundcloud.
Feel free to upload your tracks as well, but make sure your read the rules before uploading. We don’t have the time to message every author in case we can not accept his track because some informations are missing.

SoniceCube, Please don’t take offense to the things I say. I was not attacking you. It is clear that you are trying to do what is best for your client. I am talking about if someone simply gives them a carbon copy of what they are selling here. Another thing I was thinking, that I didn’t think of before, if you sell direct, there may be different uses the client has, and it would be justifiable to charge much more in some cases. I apologize. I was wrong.
Don’t worry, i was just explaining. And what you forgot as well : If i sell direct, i can keep 100% so the amount i get is higher as if i send this customer to a Stock Site.
Hope this discussion does not offend the Envato staff, it’s just a general discussion about the value of our music nowadays.
It just doesn’t seem ethical to sell through AJ exclusive and then direct for a higher price. Direct, it seems you would be wanting to give the client something project specific. Why would you want to sell direct clients stuff that you submit to stock media? Perhaps your stock media stuff is too good and you need to try to sell direct more? Even if you could work around some technicality to sell direct and AJ exclusive for the same track, it just feels very wrong to me. Just my opinion.
i don’t know why you think it’s ethically wrong ? If we should speak about ethical and moral things, then i would ask you if you don’t think it’s wrong that we all destroy the music business and devaluate our music by using a marketplace that sells so cheap ? I don’t blame Envato, but honestly all of us that we go for quick money here.
Another thing you should be aware of is, that i offer my clients either a complete custom track for a fair and locally competitive price or if the budget is low, a track from my library which i can customize to his needs. Why should i send this customer to AJ and never see him again ? Most of them even don’t have the time to visit such marketplaces and i offer the service to choose a track that suits his project and i invest time to do this.
It’s simple : The prices here are just to low and this is why this marketplace has such a success. I don’t feel i cheat anyone if i ask for a regular, localy fair price for my invested time in my music. My fix costs here per month are $5’000 so go and think if you can always act like the good Samaritan and explain your family that we have a problem at the end of the month.

Yes, i have read this sentence :“You may elect to become an Exclusive Seller which means that you agree only to sell your Products through the Sites and not through other web sites or other medium (Exclusive Seller).”
As i have checked with various other stock sites, they allow you to sell your very own items to your own customers.
You know, i run a Production Studio over here and if a client comes to my studio asking for some ready to buy tracks, i will sure not send him to my Envato account. If this is what Envato is asking us for, it’s just so out of this world. I completely understand that exclusive means, it is only available on ONE STOCK SITE, but thats it.
I know, a Marketplace can make a rule as they wish to, there is no official law or anything, but there are common practice in the business. I am sure nobody would agree that sending a local customer over to a Stock Site would be wise, and therefore Envato should clarify that statement and use the common practice in the business that says exclusive means no other stock sites and competitors of Envato.

What i still not understand is the following :
Am i allowed to sell tracks that i have on my Exclusive account on AJ to my local clients who do not use any of the Royalty Free Marketplaces ?
I’m asking this, because other sites in the same business state, that authors are allowed to sell their content directly to their existing clients. And to be honest, as author and production company owner i would be silly to send my clients over to AJ where they then probably buy from someone else and especially for 10 times less then if i sell it directly on a “regular” price base.
I can imagine what Envato will say, but is it not “normal” and “fair” if we are able to sell the things to our clients instead of ruining our business and loosing our clients ? I’m not speaking about Envato competitor websites, but our very own and our very own clients.
Any thoughts or even better legal and official statements regarding this (and please keep in mind, we all have to life and feed our families) !
and for “being a loyal member” – I also take in account referring over 400 new customers to Envato, buying over 200 items on the Envato Marketplaces. Being a active member in the Forum and AJ Author groups on Soundcloud etc. to help promoting the Marketplace. Having a tidy Portfolio with lots of Graphics for each item. This might have nothing to do with being loyal for you …... but think about it twice what loyal means …it’s not just earning money on a Marketplace !

There were a few “new” tracks but also one track you´ve sold exclusively her on AJ. I don´t remember its name and to be honest I just don´t care and maybe you removed it in the meantime and yes, it was just one track, but you know, before having the guts to participate in this very thread and claiming yourself as a loyal author here on AJ I would advise you to care about your own business.
So why do you not just report Exclusive Authors uploading their original content to other Marketplaces ?
So it’s your job to point your finger at someone else without any justification ? As i said, i opened a second non-exclusive account here and i’m moving tracks from my exclusive to my non-exclusive. I also mentioned i might have a track or two on other marketplaces now that sound similar as i re-used some elements of older songs. Probably some people think it’s not OK and i respect their opinions, but i for myself think it’s ok when i have spent another 1-2 days to make a similar track out of an existing one and there are no rules broken by that.
Your post is very offensive and you should think twice before you let go your frustration to someone else. Think about me what ever you want, but don’t post wrong facts and accusations against other authors here !
