also are you sure you just arent using copyrighted images in your themes?

You should be careful if you are advising someone to educate himself :) No it is not about images. Anyways still waiting reply from Envato Support, it has been more than 24 hours after my emails.. still no reply..

Yes envanto can remove your item.. i think it is mandatory to remove the DMCA noticed item within 24h or as soon as possible. Also a reason should be sent by Envato to your email, i`m curious what is it exactly about. Now you must wait to resolve your problems by support. This is not fair but this is the procedure. Have patience and your items will be restored.

theres actually no time limit for removal, most will remove it within 24-72 hours because if they dont they could get sued themselves,

also if the DCMA claim is false you can counter it theres also serious fines, cause to take civil suit against the original filer, its not like you dont find out who DCMA ’d your item in the first place

Actually what I cannot understand is one of the points of the DMCA notice is

2- Identify your copyrighted work (including the relevant URL ).

But the provided link by the claimer is just our plain html theme, not a copyrighted website or something else. However support team members can believe such a ridiculous claim and disable the theme without prior notice…

notice is not require, a DCMA is threat of legal action once received Envato CAN get sued and get the whole network shut down, its plan and simple easier to remove and item and investigate later, you need to file a counter DCMA notice to Envato to get your items restored if they find they dont violate any copyright infringements they will get restored and you can go after whoever filled the false DCMA

copyright law is extremely serious in some countries(not just the US) if you want to sell items you will have to get use to the laws and legalities, Educate yourself on what the laws are so you know what to do if this happens again or if someone infringes on your IP

I know prior notice is not required, but the claim is ridiculous that’s why I mention prior notice is needed for such claims, otherwise someone can claim the same for all themes here with just uploading the theme to their server and claiming they own the theme.

did the second link shows code that is similar or identical with code from your item?

But it doesn’t matter really, if the DMCA has all the info then is valid. If the second link proves or not if you stole the code is not for envato to decide. Is a complicated problem and the simplest method to get out of it is what envato listed in the “How to deal with DMCA complain” section.

You are not reading what I have written here, what my concerns are..

I have all knowledge you have provided… I hope none of you will never face the same problem I have faced.

Again and for the last time.. My concern is disabling items without prior notification, without verifying the link provided.

the first one should be a link to your item.

“Identify the item or content that you claim infringes your copyright (including the relevant URL ).”

means, “give me the link to the item who infringes your copyright.” nothing more.

Yes, it has 7 of the criterias, but the very first one provided does not show any copyrighted work. It is just a html code uploaded to any server.

Without verification, the items are disabled, this is my concern at all.
