Just as a reference – no decent developer will clone someone else’s site (moral reasons let alone you could end up with copyright issues in the future even if it is new code). It is also worth noting that the agency who designed that site were on CSS award sites etc so are recognized and their work published, making it even more of a bad idea to try and rip their work.
Realistically for a decent WP developer to do a job like this would be thousands of $.
There are several ‘similar’ ish theme son here (just look through WordPress >> magazine and this way you only pay $50 – 60 and avoid potential legal issues in the future

some theme have not included Dummy deta. so you can contact theme author. send him to message and request xml file. he will send you quickly
+1 although speaking form experience with this theme the dummy content is built in and activated in the ‘theme options’ – no need for XML file
The example you posted above nelly.com is a professionals store so I would image they have their photos taken for the purpose.

Completely agree with Tom and Iman that this may cause potential confusion.
Aside from the possibility for people to think it is a requirement [definitely the main potential issue], looking at the process for those novice buyers I wonder what % will know all of their admin, FTP etc details that are requested?
