You have to have the plugins author permission to use it in a theme. Usually they have their terms listed on their items page, but better to contact them and have an official answer.

Here are my thoughts…
- Don’t use so many different colors. It doesn’t make it complex, instead it is visually not pleasing.
- When you are trying to sell a PSD or any website for that matter, you need to use correct photos. Right now the header photo has too much going on and it doesn’t suit the design at all. Here is an example of a good use of images – 4MAT

First of all, the theme you just showed, was released in 2008. Times were different back then. If you can wait until tomorrow, then I’ll do a more thorough post about your design, but Sam is right. It is too crowded right now…
