Open a support ticket, tweet Envato and ask them to force that guy to change his item’s name or soft reject the item until he does.
Also, you could try reasoning with the author (but contact Envato Support as well)!It’s not allowed to have the same name so you should get this fixed asap..
Ruben i don’t think its good to be soft rejected a theme just for a name or small issue… some people work for month to create a theme… but sure i’m with UnitedThemes the name need to be changed!
you can make content visible by default and pick one of many BG options.
I would recommend to do that with your first item for a several reasons.

your comments seems like reasonable, but I disagree, or maybe I don’t understand something.
Can you please explain me WHO and HOW will do a “complete website solution” from the “plugin-ready incomplete website solution”? Do you know that very large part of the buyers can’t code even basic CSS rules? These people need that “complete website solution” because it is the fastest way to achieve result without any knowledge. Any step from this model will result in loosing that buyers.
Please open the Popular Files page – what you see there? Do you think that people want to buy themes that they need to build then like a framework – some of them don’t even know such word.
Try and tell me that building and maintaining your own contact form (just as an example) that is implemented separately in every theme you build is easier to update than supporting a plugin via just a few lines of CSS.
Forms and maps, twitter etc. – really good cases to use plugins. If you use them once you will feel its good thing. But I’m afraid these are only cases where it will work. And I’m imagine what it will be – part of the shortcodes in plugins, other part is in the theme – what is the point if we anyway will need custom theme shortcodes??? Its not possible to work without them, these rules are written by people who never create a theme with the current level of TF!
ThemeForest – you want your standards instead of creativity? Because I think its the most important thing in this marketplace. Why you try to apply the rules that are written for absolutely different situation?
I would ask TF team – can you make such a theme so we all know how it work in a real life and we will have it like an example? Please create advanced multipurpose theme and show us. Because if you want to change fundamental rules – please take the time to try it first yourself, before making thousand of author do so.
I like some of the items in new list, agree for most others, but I see you ignoring the question about page builders/shortcodes – and I don’t feel good about that, so are all these new requirements stay on the strong platform? I’m not sure.
