Nothing wrong with that. Authors don´t need to make it work with 2.9 if they don´t want. And remember that giving support is not a must but it is rather recommended.

To me it looks like a copy/mixture of other great themes here on themeforest, such as the theme by settysantu, http://themeforest.net/item/cimplesol-/full_screen_preview/30840

But to give you some valuable feedback, you might want to try to consolidate your colors and turn down the use of patterns and brushes to get a more clean and simplistic look.

I can´t agree with you. This is not unfair because every author is “playing after the same rules”. This is normal when the marketplace grows, and we have to accept it.
