Well it depends on the license type – if you are looking at the creative commons area and you check the license type – can use in commercial, can alter and can distribute then no you do not need permission from the author – just attribution in your help file with a link to the authors stream etc

If the work is Creative Commons Attribution License, you should be able to use the photos without permission, as long as you credit the author in your description. For the sake of being friendly, I personally would email the author a link to the file and thank him/her for the photos. Just to show them that their stuff was used and correctly attributed.
