Hi there! I do know that we cannot have images of movies, games, etc in the theme preview demo site, however, does this apply to fan art? Let’s say that somebody makes a painting of a game, will this be allowed?

Thanks!

is the ‘somebody that makes a painting of a game’ you? If so then feel free, if not, then the other person owns that image. You simply cannot use any images that are not your own, licensed to be used within your requirements, or without written permission from the ‘author’.

Jeez I knew this was gonna come up. Ok sorry I may not have been very clear: so if somebody makes a painting of a game and give me permission to use it, is that fine? Even if it’s a painting of a copyrighted material?

So let’s say, I take a screenshot of GTA and make a painting out if it, can I use that?

doubtful as it will be a representation of copyright characters, game name and much more – it’s technically illegal.

something like that falls along the lines of fan art, simply the content is copyrighted and you cannot profit off it. But some copyright holders are lax on the issues because it promotes there brand( although its still technically illegal).

Also depending on what you do it could fall under derivative work

It’s the responsibility of the author to do their own copyright research. Staff won’t be able to answer this for you :)

For some direction, please see our Knowledge base article -http://support.envato.com/index.php?/Knowledgebase/Article/View/122

Thanks!

One thing i do not undverstand is why we cannot use any images for our previews since we are not selling the template with those images? I use all envato images for the download file? The other thing is that we are hosting the preview templates on our servers so it’s got nothing to do with Envato. I think as long as we are not selling the images we should be able to use them for preview purposes only. Some templates are hard to find or get images that compliments the idea or style of the template. I have used band images for my templates and i had to ask the band or artist to be able to use their band images in my work and they all had no problems letting me use any images as long as i give the proper credits to the bands and photographer.
