Currently I’m in the same “problem”.

Why is this a problem? and why there’s has to be a DMCA when the copied item is here, in front of our eyes, and the reviewer eyes?

I simply don’t get it.
I’m super pissed about the author who copied my work.
How is this my fault, that now I need to send DMCA and what ever?
It’s not in some another website, it’s right here!

I get it though. There’s a massive amount of items. I need to contact support.  The thing is, that apparently your support ticket made them remove the item, while in my case they did nothing but say: “You need to do A, B and C.”

Oh dear.

Yeap they asked me about DCMA, but I said that that’s like stupid to write something with signature on same website like Themeforest, my opinion is that it would be reasonable if it would be different template stores. So what I did is , I’ve sent Envato, I did a compare screenshot, CSS & HTML code example that are exactly as mine code.

Explain with examples, show it visually… if you right they will be on your side!

There may be a few reasons why things go as they do:
Yesterday I reported a warez site to support. I received a reply saying they are investigating the matter however also stated the following:

If you are the original copyright holder of the items you are reporting, it is important that you also try sending your own DMCA notice, sometimes due to high volume of tickets we cannot address all the copyright cases.
Also there is a difference to what’s the right thing, see whats wrong and make it legally arguably (my english may not be clear here).
However in order to get the copied items removed as quickly as possible:
  • File a ticket to support always
  • Contact the author through his profilepage who you think copied your item

I wouldn’t spend more than a single second if that would be only similar or anything like that. This author literally Copy&Pasted my JS Code, Html Structure, CSS code, and even the textual content. Would u believe on that?

I tried what you suggested.
I made a YouTube video that compare between my item and “his” item. I can send it to you.

Honestly I don’t know what to do right now as I really never been in this place before.

No one wants to hear and seems like no one gives a … The item is still there while this author might keep steal copyright unless he’ll be punished or at least warned. That is, of course, has nothing to do with the fact that anyone who will see the video will say that this item should be down, immediately.
