Judging by this post: http://themeforest.net/forums/thread/can-i-include-a-plugin-in-my-theme-package/77729 , it’s okay to include existing WP plugins (from wordpess.org) in your themes.
There are few ways in my mind to do this, create a plugins directory with the files (which the user will have to manually copy and activate) or include the files in functions.php
My question is, which is the common way on ThemeForest, judging by technical and legal point of view? (Does ThemeForest has any rules or recommendations on including WP themes?

as for common way or polices its really up to the author how they include them, just make sure you follow all copyright polices and laws
