Themeforest will ban your account if you initiate a refund through PayPal. Not going the legal way through themeforest support probably also means you are afraid of not being elegible to get a refund, then it’s probably illegal and an account ban is legit

Today I got a refund request as well because the client saw “too many bugs”(only 2 issues reported including the install issue – he was installing the main zip file).
He probably won’t get a refund, but the problem here is that he may rate the item at 1 star anytime…which in fact is just not fair.

Yeah, is far of be fair mate, really far.
I have about 2 – 3 troll users to each theme, I think is common in WordPress section, guys without any experience with WordPress thinking that our theme will do miracles XD
But, you can help nice users to ensure high rates and try the max to be nice with the troll users ;D
