can I use this tutorial in a theme?

It seems to me that most recent tuts have had a statement at the bottom saying that the tutorial could be used in a theme here at themeforest. This one does not and I really like it for my theme that I am working on. Can I use the code and styles with a credit in the theme of course?

If the theme is not based around the tutorial, but is just a small part of it utilizes it – I think there is no problem implementing the techniques into your theme.

Yep, I think so :)

Just keep in mind, that as far as I know, if the Author specify on the ‘download’ or in the ‘tutorial’ that something is under a different kind of license or they do not allow the free usage of it, that overcomes the message.

Not 100% sure, but after read some of the help files and so on, that’s what I understood, and also, they ask you, if you can, to not use 100% as it is.
