All right, if you haven’t heard yet Getty Images released 40 million stock photos to the public:

They can be used for non-commercial purposes, but this is where it gets a wee cloudy for me. Can we embed these images in item previews for HTML templates, WordPress themes, etc.? Our live previews are not “commercial” per se and often they do not contain any direct links to the item page here on ThemeForest. It would be great to hear from Envato staff and other authors.

Well, i’m not so sure about it. The item page on TF serves as a sales page, and generally this is where the whole process of selling and purchasing takes place. What if someone visits the live preview site without knowing about the actual item? Plus, we are not selling the images with the templates, they are for “preview” purposes only.

This does not matter. What matters is the purpose of the preview an why it was built.

Ok, but you stated that the images can be used for non-commercial purposes so what really matters is the purpose and not if they are redistributed.
I’m not a lawyer, but this still sounds pretty clear to me ;)
