Hello there,

I was wondering for future reference are we allowed to submit themes that we are using personally? or on our own business sites? OR for example:

a client has a low budget, so for a reduced price we get them to agree that the template we will use for them we are then allowed to sell here?

I’m pretty sure this is not allowed after reading through all the legal documents, but wanted to double check as I kind of overdosed on it all.

Cheers! Alex

If you are an exclusive author and you create a theme for a client, then you cannot resell that theme here. However, if you create a theme, upload it here and then the client buys a license for it then the client can use the theme and you can customize it for them.

Now if you create a theme (exclusive author or not) and you use that theme for your own use, then I think that’s permitted but I’m not 100% sure. It wouldn’t make any sense to purchase a license to your own work now would it? lol Let me check the legal docs and I’ll post back if I gain clarity on that one.

EDIT : I checked and didn’t find anything right off the bat that says you can’t use your own work for yourself. But, you might want to contact support or ask Jeffrey to be 100% clear. :-)

lol good point, would be rather mad to purchase a license for your own work. I will contact support just to make sure ;) and post back with my findings.

Cheers for a speedy and clear reply :)!

Had a reply and it is as follows :)

Hi Alex,

Thanks for emailing Support. You may submit files that you use personally on your own sites as an exclusive author, however you must not sell those files on any other site (personal or not). So you may use your own content, but you must not sell it anywhere else.

I hope this clarifies it for you!

Cheers!

Regards,

Jordan

Ah, good. Would’ve been a little crazy if we had to buy licenses for our own work :)

It depends on your definition of slightly modified. The template will need to be different enough that they can be considered two separate templates, otherwise it’s considered copyright infringement. That shouldn’t be too hard to accomplish quickly though. :-)

I don’t think this is allowed (may be wrong). As it will still be based around a design made for somewhere else and as an exclusive author, that’s not allowed.

However as xmdsys pointed out. You can get your client to purchase this, you then customize it for their needs.

Edit: Did not realise xmdsys replied :P Sorry!
