Hi,

First of all I am just asking for personal knowledge and information only. I am not a developer or big designer. Cloning a website functionality or website design (apart from logo or trademark) is a crime or illegal or NOT? Can anyone please answer to it with some explanations. It will help me to better understand.

Yes it is a crime. It breaches copyright to use someone else’s design and or code.

Even if you were to remove their “logo” or change their colors and even layout somewhat if you are just ripping and modifying someone’s code (or design) then that is not right

Thanks for info. My question was actually that, if someone is Designing everything at their own from scratch and writing code from scratch as well in a different language and NOT copy any element or file. Rather just looking at a site and designing same with using their own skills and coding and building their own functions by just surfing a site or looking at it. What it will be in this case?

If you mean creating a new version using different design and code then it is better HOWEVER if it looks the same/very similar (just changed logo and trademarks) then that would still be breaching copyright.

There are all sorts of issues but the bottom line is that if someone creates a site and then you produce one (even if with different code/platform) that looks VERY similar then the original author would be well within their rights to submit a DCMA.

If this is in any way related to making a site for sale here then it would have no chance of getting on to the marketplace

Its not about what I feel. Its about what the actual policy says in copyright rules. On other hand if someone copy some of my drawing and draw it with their own hands and skills. I think there is nothing wrong in that and my drawing will still be different as original is original.
