How can I get Expression Engine to remove their menu because it infringes on my copyright. I have made many menu’s like that.

I would also appreciate they remove their footer copyright and links information because it is similar to some I made, not to mention the fact that they use rounded rectangles which are similar to some of my own work.

This is plainly a ridiculous demand on their part.

What disturbs me is this part:

why would that person contact Ellislab instead of Envato like they should have?

I’ve seen a lot of similar themes ( especially Joomla themes ) .
by the way this kind of slider has been used in FLASH based websites. maaaaaaany years ago …

this happened before ! I still remember..
the theme was removed from Themeforest
and after a long discussion on this forum
they allowed it . ;) it was cooool and ridiculous in the same time. :)

if it’s just the slider/tabs that are the problem then why isn’t it possible for the author to change the offending code and resubmit the template? (i’m not saying whether it is offending , either way the question just needs to be asked) I’m quite surprised that there wasn’t any consultation if it was just a part of the template rather than the whole.

I wouldn’t resubmit with any changes because at that point it’s almost like admitting fault in the matter. By changing it you would be showing that something was wrong with your work, which isn’t true.

Not sure you can do anything about it, other than pull any/all themes you have up and go elsewhere.

Not so sure about that. I’ve had a copyright infringement report again my theme as well some time ago. Being a new author here, I probably worked on it, including the admin panel for more than a month.

For me at least, it wasn’t something I could’ve let go easily. So, although the copyright claim was pretty close to ridiculous, I made some drastic changes to the homepage and it looked even more different than before.

My concern was also for the customers who already had purchased the theme and now were worried why it was offline. Not to mention I had a round of fixes + updates to get to them and I didn’t want to disappoint anyone.

Envato should bring this template back immediately. The whole situation is embarrassing enough yet.

I guess so, yes. But in my case it wasn’t a DMCA notice.

From what I was able to figure out later on, I think the author of the website which I supposedly infringed upon made the copyright claim, because I got a pretty nasty message from him through the messaging system here on TF.

I didn’t reply, ignored it, decided to be grateful that at least I won’t have my account disabled and funds confiscated because someone thought they designed something so unique nobody else could’ve imagined it and moved on.
