@ WPExplorer thanks :)

Just want to be more clear on my positions. I don’t think marketplace managers should replace the current community managers. KingDog and Carmen have been great and both do great work.

The problem with handling the community on a global scale is that there’s a LOT of authors! About 20k last time I checked :0 So it isn’t easy to a) get to know all 20k authors, and b) understand the technical nuances of each marketplace.

Here’s an example:

1) Author A uploads work.
2) Author B copies author A’s work and uploads it.

Solution #1 (global)

1) Write support
2) Battle of the DMCA ’s

Solution #2 (Marketplace Specific)

1) Author A contacts the Marketplace Manager. Author A is a well known and respected author and has had a working relationship with the Marketplace Manager for years.

2) Marketplace Manager, being experienced with the marketplace’s technology, is able to take a quick peak at the code and confirm that Author B’s item is indeed a copy. No need to contact support and play the DMCA game. Marketplace Manager corrects the problem. Case closed.

Now I don’t know about you guys, but solution #2 sounds a lot better to me. And this is just one example of many others where having a marketplace manager is a big plus. And I think most authors who were lucky enough to be around when we had managers would agree.

For me its easier to ignore these people then to waste my own time and effort dealing with them.
Yeah but you are a well know, elite, plut paw author with lot of items and a solid position in the marketplaces. Like many elite authors, you can afford losing a bunch of sales and just move on, i did it myself multiple times.

That’s not the case for new / not popular authors with limited portfolios who maybe only get most of their TF income from a single item.

Competition is already insane when playing by the rules, Envato must work much harder to make it fair and to ignore the problem by just relying on DMCAs is ways less than authors deserve.

in my opinion community is one thing and authors are another another thing. As authors, we are part of the community off course, but we are also business partners of some sort. As a community, together with the rest of the members we are very happy for the presence of the community managers, but as authors we need someone or more, from the staff to interact with regarding certain types of problems that only authors have

While anyone on our Support team can take down a file, disabling an account is a more serious matter and can’t be done by just anyone.

The mistake here is letting certain level of support dealing with authors for issues they have no authority. We need to speak directly with the competent staff who have control and can take quick action when need it.

Is obvious that support will request for a DMCA when someone will just ask them to investigate some claims. They ask for the DMCA because they have no instruments and authority to investigate that issue except complying with a takedown request as required by law. Maybe they pass those claims higher in the hierarchy, who knows, but we still have all this examples so something is clearly not working.

There are a lot of problems that can’t be resolved by myself sending DMCA notices left and right.

For example, I contacted the staff at some point about an user who earns referrals money by having a link posted on a noted warez website. That link is posted in a certain area where only the owners of that website can make modifications. So is not a simple user there, but someone who control that website. I don’t know if is illegal to have a warez website with items from envato and earn money from referring buyers here at the same time, but is very unethical for sure. In the end, money earned from referral program will be used to keep alive that warez website. Don’t know about others, but it drives me mad if he drinks one coffee with money from envato while at the same time he post thousands of genuine links to real envato items (and other marketplaces). Like how idiots we are? How clever is he then? Maybe he deserve those money after all.

So I contacted envato about this issue and give them all the details, till now that user is still on this website (verified 5 minutes ago)

Add a copyright insurance ,each dev`, artist, atc` as option that want can pay a monthly $1 fee, this way envato can pay a full time salary to 1-3 stuff that really know coding with the power to hunt complained like this on the envato market alon and adapt all the suggestion as bidfade (and say it someone that realy don’t like the guy :P ) .

…logic to me …. But will never happen here :P .

Bottom line elite author suffer hundreds of dollars monthly in damage due to copyright issue and no one really do anything about this

That’s not true. Items get disabled/removed without a DMCA in many other cases. To verify whether an item is broken because a buyer reported it is hardly different than checking whether it uses code from another existing item or not.

I have been contacted by support because a buyer reported a bug in one of my items, they asked me to fix or they would have been soft disabled it, i gave them proof there was no bug, they verified i was right, case closed.

Copycats claims should just be handled in the very same way.

+1 as it can easily be checked.

Also a dmca is not needed as Envato has the rights to remove any item without notice or reason, so why a dmca is needed is beyond me :/

Here is the part where it states it and i quote:

“Envato may refuse, in its sole discretion, to allow you to offer the Product for sale on a Site. Envato is not required to give reasons for refusing to allow you to offer a Product for sale on a Site.”

and

“You acknowledge and agree that Envato may, at its sole discretion, elect at any time and for any reason to remove your Products from a Site without notice to you. Envato is not responsible for any loss that you may suffer as a result a Product being removed from any of the Sites by Envato.”

I remember a forum thread from 10-15 days ago, about an user’s account being (temporarily) disabled because she had a link to her website on her profile page… How can this be more important than somebody who steals and sells the stolen products?

Hey guys. I’m going to get Support to chime in here about their process. I don’t want to put words in their mouth and I think it’s a very important topic.
