Images in which authors do not have permission to use should not be used in the download files or the live preview. While we obviously can’t control live previews, images without appropriate permissions still shouldn’t be used.

The item can still be disabled if the live preview presents copyright issues.

@marcfolio – It’s best if you don’t post links to other author’s items in the forums, especially in discussions such as this. If you feel an item is in violation of copyright or something else, please report it to the support staff.

Yeah this is something that is very hard to keep track of. So many files, authors, and images. As long as copyrighted material isn’t included within the final download package I wouldn’t see it as an issue for just a live preview. However, I would recommend all authors use proper judgment with everything they display publicly, including live previews.

Hmm , then why don’t you guys disable the 3 exemple that were given ??

I don’t get it …. Live preview are meant to show what the theme look when it’s “live”. They are not part of the item itself. It’s like a grey zone right there.

If it is violating a copyright rules , please tell me wich one since I don’t sell the image , I do not pretend it’s my work , I do not include it in the final theme …

Like I said before .. Electronic store play movie on their LCD screen all day long and it’s totally legal .. Do they need to have liscence from productor ? No because it is just to showcase how their TV work , nothing more.

They don’t make people pay 3$ so they can watch the movie with popcorn :)

Anyway , I don’t know what to think about that.

Author’s are personally responsible when it comes to copyright issues, especially on live previews. If you don’t have permission to use an image, the owner of that image could contact your web host and request that your site be taken offline (or something else) until the image has been removed.

The electronics stores playing those movies have special rights to do so from agreements and contracts they have setup. I’m sure there are plenty of stores that play movies like that illegally and are never caught but that doesn’t change the fact that it is illegal.

Believe me guys, copyright issues can be a pain and are sometimes so ridiculous they want to make me rip my hair out… In fact, just today I encountered a copyright issue of my own fault that could have been quite detrimental for me. The number one rule in regards to copyright that I live by (and today is a reminder of how important this rule is), if you don’t have explicit permission or you’re unsure as to the copyright details – always contact the author and obtain it before use.

Sorry. I wasn’t trying to get anyone’s file knocked. And I didn’t realize that the live preview isn’t hosted on the envato servers. Where the live preview isn’t hosted on the server I would imagine that authors are left to their own judgement which images they can use.
