Actually I do understand you, but this is written in a way to protect yourself and give you an option to do with the items at your own will, the main reason here that i am concerned is the reason that authors are opening threads and complaining and that is that with this you work on principal guilty until proven innocent and not vice versa as majority of court systems work. And its a bit harsh what i am going to say but dictatorship and iron fist rule works in this fashion.

I totally agree. Same thing with unfair rating. Authors have absolutely no chance to defend themselves. Few weeks ago I got one star from a buyer who could not install HTML theme as WORDPRESS. He could give me as well one star because this theme is not a camel! When I asked Envato to remove it because it’s obviously wrong, they told me “Sorry, we can not do this because he didn’t break any rule”. Seriously? I can not comment it anywhere, I can not contact the buyer and the rating comments are not public, so other buyers can’t see why he gave me 1 star. Because of one genius the sale is going down, but who cares, right? So when Envato is going to start protecting the authors?

Rules are rules, and I agree with them… but this part:

“We may remove an item from our Marketplaces at our discretion, for any reason and at any time without notice to you’ ”

.. is simply unprofessional from the Envato.

You do know that some of the authors need to feed their families ? What’s up with you being community centered and not once wanting to contact the author about their item ? First disabling items, now even deleting…
In what dimension do you live? Who will take care of you – except you?

Really scary and disturbing part…
Hey Anps, sounds a little heavy handed in isolation but we need to be able to do this to protect our community and make sure our Marketplaces contain items that are legitimate and deserve to be on there! Nothing new, just a little easier to understand now!

I believe this is something which may happen one in million. Envato is just keeping the rights for itself and this doesn’t mean they will use it everyday.

It’s really important that this quote is read in context:

We will not be held responsible for any loss that you may suffer as a result of your item being removed. “

I’d encourage anyone concerned about this particular agreement to search the Wordpress and HTML categories by Date > Ascending , which will give some perspective on why this is necessary :grin:

I have nothing against the new rules, because you have to protect yourself at the same time to satisfy photographers, I work in the media and I know that all of the hassle of law. But I was a little disappointed with the poor sales images. I was expecting more. Even I’m disappointed about acceptance and photographs are funny reasons for denial.

I’m sorry but this does not justify the “without notice to you” part. This practice is unethical and immoral.

First, a big congratulations to the team who’ve been working on these new terms and the rollout for quite some time and have put a tremendous amount of effort in to make them as good as they can possibly be. It’s really quite an achievement I think how much clearer they are!

I noticed quite a few comments asking about the line in clause 27, and thought I should write a quick response:

27. Library review: We like to keep our Marketplaces fresh and full of quality items that meet the latest technical standards and market trends, and so we may review our libraries from time to time. We may remove an item from our Marketplaces at our discretion, for any reason and at any time without notice to you. We will not be held responsible for any loss that you may suffer as a result of your item being removed.

There are some rights (like this one) that are important to reserve for the occasion when you need them. Being able to pull an item off the marketplace quickly before notice goes out, or if it’s not possible to send notice for some reason, is an important capacity for us to have, so we keep it in the terms. That doesn’t mean we exercise it arbitrarily, or that we don’t subsequently send notice to the author in some form. So I wouldn’t want authors to be alarmed by this line!

Not that it makes the meaning any different, but for reference, this line has always been in the terms, you can see it in our old terms here on archive.org.

I’m glad to see everyone having a good read through the new terms! Please do keep letting us know if there are things you think need clarification!

I have read and searched for… it seems the author terms do not include any statement regarding authors who provide support and or advertise free support including installation and / or customization included in the advertised price tag, as discussed here http://themeforest.net/forums/thread/wordpress-theme-authors-who-are-giving-away-free-services-install-etc/130016

To my opinion and other authors, to advertise free support and / or free services is not practical on the long run and creates the impression/belief to the customer that she/he “should” benefit of free support from any author, anytime, anything.

Many authors don’t make clear their support terms on defining the border between support and custom work and / or other services. Some (especially new ones) provide various services for free as a means to enter the market.

I believe such practices are acts of not-loyal competition and have to stop. I am referring to advertising and providing free services. This creates a wrong image of the marketplace in the eyes of customers and damages other authors who don’t afford the time to do the same.
