pay it under IT services/ maintenance , you don’t need to pay service tax. It is only applicable if you are getting money in India for services rendered.

Yes, you have to pay tax on it. In most cases, it will come under income from business / profession. If you have a day job, I’d recommend you show it under income from other sources.

As regards the service tax – yes, you are liable to charge and pay service tax on it. The ST, VAT and Excise provisions relating to software are very complex. If you are earning a substantial amount here, you better get a good tax accountant.

Freelancing comes under “Profits and gains of business & profession” and so filing tax returns is necessary. Definitely you need a tax consultant.
