Hello,
I’ll ask quickly and precisely:
Can I (videohive author) monetize my youtube videos (videohive previews) which contains AJ music (watermarked audiojungle previews)?

If I need regular or extended licence – ok, I can buy it. Btw is that somehow defined in rules?

But even if I buy AJ item, I’d like to use watermarked music to protect AJ author from ripping his track from youtube.
If, according to AJ rules, I can’t monetize my videos, can I ask AJ author for written permission to use his watermarked AJ preview in my youtube videos.

I don’t think watermarked promo use on YouTube is defined anywhere officially, but I’m pretty positive any AJ author would give permission to use their watermarked preview audio on YouTube—in fact it’s something many authors try to do themselves and find time consuming and difficult, so any free exposure on YouTube (particularly if you’re getting enough views to actually monetize) would be a hands down “go for it!”

If you use a watermarked preview, you should certainly link to the AJ item page where it can be found in the video description (as I’m sure you do). If you for whatever reason didn’t want to add a credit/link to the AJ item page, purchasing a license would absolve that responsibility. I also agree with you as an author that I would prefer the watermarked track to be used here over a licensed regular track in this case. It is a win-win.

In any case you wouldn’t need an extended license as the video is free to view, regardless of monetization. From the License FAQ: “As long as the end users can freely access the end product, the regular license is fine. (Example: a YouTube video that’s free to view )” and “No, just using the item in a commercial setting doesn’t necessarily mean you need an extended license. You need an extended license if the end product is sold to end users.”

But for this https://www.youtube.com/watch?v=5TwMTF84jCk and more videos, youtube sent me this:

I don’t want to violate any TOS (envato and youtube), and AJ author personally.
Maybe will be the best to ask authors to sign piece of paper, scan and send me, if envato is ok with that.
I just flagged 1st post for staff reply.

Very interesting! Thanks for the background info and notice details from YouTube, I see now where your concern comes from. I agree I think author permission would be the easiest verifiable method. I bet you could even ask for a written permission form to encompass an author’s entire portfolio, to save effort and establish go-to collaborators. Will be good to see if Envato has an official stance.

As long as it’s free to access by users, even if you’re generating revenue from the video, a regular license is fine.

The only time you’re able to use watermarked previews off of our sites is when you’re specifically promoting those items. For example, you are allowed to put your own AE project previews on YT as long as you’re just promoting that template. In that case, you’d need to link right back to the file itself. You could NOT just use a watermarked version in another project. For example, you couldn’t use watermarked audio in a YouTube tutorial unless you bought a regular license.

Thanks Travis. Everything is absolutely clear. It’s all about promoting VH template, nothing more. Since that kind of AJ items usage is very specific (watermarked AJ in VH item promotion on monetized youtube videos) and it’s not defined in envato rules, I’ll ask AJ authors for written permission to avoid problems with youtube. One additional boring step, but I’ll be safe. And problem is solved. I just need to find template for that kind of permission :)

If I customize something for clients, final video for him is of course without watermark.
