A while back, one of the reviewers opend a thread here, which stated that the files should work with out Javascript, and that an site wont be approven if it does not work without Javascript. I see some new sites which wont work without Javascript, so whats the deal with this?

It seems like a few of these are sneaking by lately. Maybe they’re just mesmerized by the “originality” and forgetting to check those basic things.
Well, I think it’s better for your buyers and sales and you should make your templates always to work without javascript.
Also I think TF should only approve templates when the main structure is working without javascript when it’s not nessesary that javascript is used. Because you can’t get Creative Zodiac to work without javascript I think

From what I understood from the previous threads regarding this issue, I’m pretty sure that it’s fine with or without javascript as long as the site doesn’t look broken without javascript and none of the major functionality of the theme is lost.
Besides, it’s always a good idea to have themes with javascript fallback functionality anyways.

@solwyvern – The template i noticed actually is messed up without JS. The pictures from the slider cover up half of the page. And it’s not only without JS, before jQuery kicks in that issue is there.
I guess the reviewers let a few slip through occasionally. But obviously something like a slider won’t work to well without javascript (unless you want to get messy and make a CSS one).
Yeah, but you can make the slider not mess up 50% of the content if JS is turned off 
Like hiding overflow.
