I believe that using any type of recording device to record a show or a music from tv, internet or radio is illegal, if the content you record and archive for yourself or for share with others, is not under a license that can let you copy or share the product.

Is a gun illegal? One can use a gun to break the law in many creative ways but it still a legal thing since the decision to break the law was made by a human not by the gun. If you record Start Trek is not the fault of the VCR .
But if someone uploads a copyrighted video on a website then is that website fault! How this is even possible?
if I upload an item from your portfolio on megaupload, then is megaupload fault? Apparently yes.
This is the logic of our days. Is like after a murder, FBI arrest the owners of the corporation who made the gun used by the assassin. But the assassin is free to go.
But you may say “megaupload owners knew that the website will be used for breaking the law when they create it!”
and the gun makers? They don’t know how the guns will potentially be used by the clients? They made them as lethal as possible, as perfect as possible, to do perfectly one thing: kill other peoples.
So there is intention on making profit from a potential criminal activity, as there is intention in creating a website as megaupload to make money for a potential illegal sharing of copyright material.
