It’s always been a split license, you are the one who need to accept this. It you purchase a split license you have to respect it, otherwise legal action can be taken against you.

So everyone here knows that all WordPress themes which are sold here are NOT 100% GPL and you are the only dude who thinks otherwise? :D

From the knowledge base:

The PHP component and integrated HTML are covered by the GPL. The rest of the components created by the author (such as the CSS, images, graphics, design, photos, etc) are covered by the marketplace license.

If you understand English you should understand that this means that if you buy a WordPress theme from here it’s not 100% GPL and if you use it as such you are breaking the license.

any JS that uses any JS stuff from libraries included with WordPress is GPL.
jQuery is double licensed (GPL/MIT), just because WP bundles it that doesn’t make jQuery itself part of WordPress.
