Could someone from Envato staff shed any light on this? How can a person post a rating after he asked and received a refund?

Little white lie perhaps? Aren’t refunds given only for themes that do not perform as advertised? And in this case wouldn’t you have gotten a message from the reviewer or a soft-disable for your item? Sorry if I’m being naive here!
LOL Maybe he/she never received a refund (as girlscancode said), but if he/she did and was still able to rate the theme, then that’s a problem envato should take care of

Probably someone who was thinking he was buying an HTML ‘theme’ and wanted to open it with Muse and puts all of his frustrations into one mouse click.

I hope this review is not from your last theme. It could easily ruin sales although the theme is great.
I think issues related to ratings are one of the things that really concern authors here.
