It seems that ThemeForest is a place where someone can’t do proper business anymore. Just an hour ago our Lens theme ([link removed]) was deleted because someone filed a DMCA takedown because we have stolen everything (these were their words) from the [name removed] theme.
Well if that is the case, I will leave it up to you.

In all seriousness, I cannot see any similarities, it works and looks different (Obviously themes like this are going to look Similar as most do in the photography category)

Yes they’re similar but far to be the same thing. [name removed] is better.
@webinpixels: We can guarantee that there aren’t two similar lines between these two themes – the DMCA concern only the visual part.
@mountainthemes: It doesn’t matter if it’s better or not – they DMCA request claim to be the same thing.
On this one I would say the DMCA process failed. I did only a brief surface scan of the designs but I see nothing that would be considered copyright infringement.
Something working against you right now is an unfortunate track record of getting too much “inspiration” from other themes. I remember the original version of that theme you released on May 2nd, 2013. That would have been a valid DMCA in my opinion.
they might look similar but I dont see what you have stolen. However im more concerned that TF/envato would just delete/disable an item without any basis other then receiving a dmca complaint. I think it should come naturally to compare the two items before they take one off just like that. And looking at them both I dont see what is ‘stolen’ in your theme. The drag concept doesn’t belong to the [name removed] author neither does placing the menu in the sidebar.
