I have a question here and I hope someone may be able to answer.
1. Is the regular license enough for people who want to use a WordPress theme with WPMU or do they have to get the extended license?
I would also like to know this please
WordPress
Regular License Examples The Regular License could be used for any of the following:
1. Single website (commercial, personal, or non-profit).
2. Single website for a client (commercial, personal, or non-profit).
3. Single intranet site project.
Extended License Examples The Extended License could be used for any of the following:
1. Template for a web service such as WPMU.
2. Part of a software package for sale.- Author was Featured

Thanks, I guess I missed that
What if you want to use the theme for the main WPMU site but not make it available to the WPMU members, technically it would be on a single site, however technically it would be on a WPMU site, the extended license needs to clarify that. You can install a WP theme and not make it avail to its members.
I think the keywords there are “a web service”. So if you have a WP MU site where members sign up to start blogs then you would have to get the extended license.
This is kind of tricky to say because, what if it’s just a network of sites for a family, or a non-profit, or it’s just someone who does it for fun? I would imagine if you go to get a custom theme it would cost the same as most extended licenses here. But the wording is gray on these areas.
Also, with WP and WPMU getting merged, I think the wording of the extended license needs to be looked at again, as WP 3 .0 will have that* option by default.
Edit: By “that” I meant the MU option to host multiple blogs with one install.
I agree the wording is grey, I interpret it as one instance. However since it is grey, I do not want to be the one to test the system out. None of my users would be able to use it so it really is just one instance of it being installed on one domain.
I think they need to revise it to:
Regular A single domain, subdomain or directory Extended Multiple domains, subdomains or directories
