That’s a good question. Technically, you’re just giving a finishing product (an .avi or whatever) so the buyer can’t customize it or use it other than watching it to learn about your theme so my guess would be that you can? Although it’s a touchy subject, maybe someone like Jeffrey can explain it a little better.
