I’m currently collecting demo content for my new item, and i got an idea to use short (couple of seconds) cuts of videos from Vimeo. Could that be considered as ‘fair use’?
I’ve noticed that couple of high selling themes used Vimeo videos in the past(self hosted; not embedded), not sure if they got the permissions form authors.
I have the feeling that many of them don’t have permission from the authors.
I suppose, because I contacted once an author of already used video in a theme (not a popular one) and the cost per second footage that the author of the video told me was off the charts. I don’t think that a themeforest developer would agree on that and still I saw it in a demo..
I’m always looking at the license of the video, if it’s not specified, I contact them.
It will be good to know how the other author proceed and how they find their videos.
You can always ask videohive authors if you can use their vimeo or youtube videos. AEDADDY has awesome videos you might want to ask him if you can use them in your themes or templates.
You can link his portfolio from your item and give credits accordingly.
Sure. The same previews are on youtube too, if you need.

From what i know, Vimeo videos can be embedded without any consent of the author. But to take cuts from the video and host them you should contact the author.
