I’m allowed to be amused and discuss that whole shenanigan as I’m not an author but merely a support staff, so I don’t need to produce anything. Phew, guess I dodged that bullet! :nerdy:

Hi everyone,

Lots of valid questions in this thread which we’re very thankful you spotted and shared, thank you! We’ve taken a look at what has happened and have noticed some oversight that should not have occurred. Had that oversight not occurred, there may not have been any confusion or concern, but we’re glad to share and explain what’s going on and what didn’t quite go to plan.

Transfer of Item/Account Ownership

Recently, we received a request to migrate customers to an item that had changed ownership outside of the Marketplaces. Our goal was to perform a test to determine if this could be done technically, at what cost, and to see what bugs, if any, would arise. Throughout the process our main objective was to do this in a way that would be in the spirit of “Fair Go” which is one of our company values that we strive to achieve for both internal staff and our community. We believed that we could accomplish that objective by ensuring the following:

  • The item would skip the “new items” part of the homepage
  • The item would not show up in the Popular Items page due to a sudden large number of buyers (transfers)
  • The author would not be listed in the Top Author section of the site
  • Past buyers would have access to the item and all future updates

Unfortunately, we did not consider the upload date and what that meant for the theme’s placement in the eCommerce category. We’re currently trying to fix this oversight and we are confident we will be able to rectify this. In the meantime, we apologize for the confusion this has caused so far but would like to thank you for your continued patience while we resolve this issue.

Author Exclusivity

Regarding the concern that an Exclusive author is also selling the item from their own Web site, we can assure you that all current policies regarding exclusivity are still intact and in place: Exclusive authors are not allowed to sell items outside of our Marketplace. In light of this, we will work with the author to research why/how this has happened. The bottom-line is that it’s not allowed and there’s no intention here to give any authors, either past, present or future, any unfair advantage or exceptions to existing rules. Please allow us some time to investigate this behind the scenes with the author before rectifying the issue.

Policy on Item Transfer Between Two Parties

As for our policy on transferring items/themes between owners, we do not presently have one. Our immediate focus right now is to better understand the technical aspects of these transfers before creating a policy around that. We do have a few more tests scheduled in the future, but won’t have an official policy for several months. What we do currently have ‘policy’ on, that you may have already seen in our forums, is that we do not allow discussion of item sale/transfer in our forums. When we see these threads, we disable them but we keep a record of them internally for future reference. With this in mind, we politely request and suggest holding off on posting any item transfer requests in our forums or via a Support ticket until we’ve determined the best way to move forward with this and provide a fair and reasonable solution that benefits our community.

Update: July 7, 2014

The issue with the upload date of the item in question has now been rectified. This means that it no longer appears on the first page of http://themeforest.net/category/wordpress/ecommerce.
