I’m using a flash component that says “Free for commercial use” but what you think about the license?

“You can use “The Product” free of charge for your personal and/or commercial projects. “The Product” may not be redistributed or resold to other companies or third parties. Specifically, “The Product” may not be redistributed as part of a content management system or online hosting solution. Any credits or copyright notices must remain intact.”

I think that if the owner does not permit to redistribute the file in a CMS I need to remove the extended license option to my template.- Even so, should not be a problem.

Can I sell a theme with that file? Sorry about the silly question but I need to have that clear. Thanks :)
