I think it is a good start, like your layout. As for the background images i would use the bg stretch jQuery plug in or have a custom code that resizes them according to the screen size.

Thank you for the feedback! Much appreciated, I assumed that it does stretch using css width 100% and height 100%
But I can just insert it into the resize function to change all to new screen width and height

I’ve created the navigation for “About” and “Contact” I’d love to hear your feedback about that before I go and do the log in and register page.

In it’s current form I don’t think you have much chance of approval. Photography themes are hard to get approved. I submitted http://www.webbymatt.co.uk/themes/impact/ several times (it’s a WP site) and after making some big improvements, I asked the reviewer candidly if he thinks it will ever get approved – the answer, though diplomatic, was no.
this doesn’t mean your theme has no chance, but from experience I think it needs a stronger element of uniqueness.
