Is not official, but i guess the answer is “obviously”!!! I will never buy a themplate if is not valid, not only the html, css too.
Then I guess you won’t buy anything with browser-specific CSS declarations?
Seriously now, they do need to validate, but if your CSS for example doesn’t validate because of properties like -moz-border-radius or similar, that’s ok 
I am asking because WP engine automatically adds something like this: role=”search” or doesn’t add ul before li when you activate some widgets
