I did read your points, and I do agree with most of them, however I also think the shot down at the start of your statement was unnecessary and inaccurate.
I’ll be rude, but you’re not a designer at all ; please do your homework before trying submitting templates to ThemeForest.net. I just want to help you here and I urge you to read this article and do what it say.

Take your time, put some love in your works and you should get it. I see potential in your current template, but I also see that you need improvements with :
- Adobe Photoshop
- Your Sixth Sense (Designer’s feelings…)
You have to love what you do. You woke up in the middle of the night because you HAVE to design something you just dream about… You woke up the morning and you just want to sit down at your desk and design something new, something exiting, something that say something… It’s your passion, your live style.Cheers!
Personally I disagree. No, he may not have the same experience under his belt as a lot of the authors around here do, but I don’t think that’s grounds to go out saying somebody can’t design. Everyone starts out somewhere, you can’t tell me you were perfect at your first go on things either. This is somebody here merely looking for constructive criticism on how to improve their work. There’s no harm in that, and quite frankly, I don’t think theres a community better suited to answer that question.
There’s no harm in asking how you can improve your work after an honest attempt in trying to pull it off.
I like it, Thomas! , but can you make it less “dirty”? The big paw on the side is impressive!
I agree though, the design looks pretty sick, I’d buy it or something similar if it was offered. I DON ’T find it too realistic for Envato to start up their own clothing or merchandise market, or anything of the like, however I do agree it would be feasible, and profitable, going through and selling custom branded clothing that could perhaps be sold as merchandise perhaps in a similair style to deviant art. Envato COULD have a shop without necessarily having a marketplace dedicated to it, and I personally think it would be quite effective if presented right.
I think the colours of the background jump a little too much and come out a little harsh, more so fading from the red I think, as well as the “read more” and “purchase” buttons could look a little more sharp, perhaps just by refining the edges a bit more, but I like the overall style on this one.
What makes you so certain he stole your theme and isn’t one of the people who purchased it? (Or perhaps had somebody purchase it for them on their behalf)
Might I suggest maybe making the submit button a simple greyscale gradient in similar style to what you’re top navigation is?
I also think the headers for the sidebar widgets need a bit more depth somehow. The solid colours just don’t seem to work. Maybe just add a really thin drop shadow or border or gradient or something?
I also can’t place what’s wrong exactly, but the search bar looks a little out of place too.
