Seems a bit lame to blame it on the Apple placement. Other templates clearly didn’t get the same restriction. Stick to the original statement: this just isn’t aesthetically pleasing enough.

That one isn’t using it as part of the design, its part of the news story. Which excepts it from a copyright complaint.

FYI : Apples Terms on using their images in media

In short: No, you should not use Apple products on a design at all for anything.

In long: “This right to use is personal to you and is not transferable by you to another party. The Image cannot be used to promote or sell any product or technology (such as on advertising, brochures, book-covers, stock photos, t-shirts, or other promotional merchandise). You may not alter, or modify the Image, in whole or in part, for any reason.”

Not that this was an obvious reason why the design was rejected but it should be kept in mind for everyone designing templates.
