This errors refers to low PHP version. It should be 5.3 or higher. Just contact your hosting provider and ask them to increase your php version to 5.3 or higher.

I am not amused to see a lot of customisation seems to work only via css in your new themes and not in Select Options (> Footer f.e.). Will you change this or is this new way of customise your themes?

Glad to hear it is figured. At the moment we do not have plans to change those things that could be easily solved by adding minor css code. We implemented a lot of other options that insures customization of other more advanced stuff.
